Here is the fine print. It is not our funniest work, but it is honest, and honesty is kind of the whole point.

1. Overview

This website, https://sexyxdrunk.com (the "Site"), is operated by Pink Stapler, LLC, doing business as Sexy X Drunk ("SXD," "we," "us," or "our"). By visiting the Site or buying from us, you agree to these Terms of Service (the "Terms"). The Terms include our Privacy Policy, Refund & Return Policy, and Shipping Policy. If you do not agree, please do not use the Site. Our store is hosted on Shopify.

2. Eligibility

By using the Site, you confirm that you are at least the age of majority where you live, or that you have the consent of a parent or guardian who agrees to these Terms for you.

3. Not professional advice

Our products, designs, and content are humor and self-expression about recovery. They are not medical, mental health, or addiction-treatment advice, and they are no substitute for professional care. SXD is not affiliated with, endorsed by, or speaking for Alcoholics Anonymous or any other recovery program or fellowship.

4. Products

  • Our products are printed to order.
  • Colors can look slightly different on your screen than in person.
  • Sizes may vary slightly from the size chart.
  • Print placement can vary slightly from item to item.
  • We may change, limit, or discontinue any product at any time.
  • We do not promise that products will meet every expectation beyond what is described in our Refund & Return Policy.

5. Orders, pricing, and payment

  • Prices are in U.S. dollars and may change without notice.
  • Applicable taxes and shipping are calculated at checkout.
  • We may refuse, limit, or cancel any order, for example for suspected fraud, a pricing or product error, or an address we cannot ship to. If we cancel an order after you have been charged, we will refund you.
  • You agree to give us current, complete, and accurate purchase, contact, and shipping information.

6. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy, and returns, refunds, cancellations, and claims by our Refund & Return Policy. Both are part of these Terms.

7. Errors and inaccuracies

The Site may occasionally contain typos, errors, or omissions in product descriptions, pricing, promotions, shipping times, or availability. We may correct them, and update or cancel affected orders, at any time without prior notice, including after you have submitted an order.

8. Intellectual property

  • All designs, artwork, text, graphics, logos, and other content on the Site, including the names "Sexy X Drunk" and "SXD," belong to us or our licensors and are protected by law.
  • Buying a product gives you that product. It does not give you the right to copy, reproduce, or sell the design.
  • You may use the Site's content for personal, non-commercial purposes only.

9. Reviews, comments, and submissions

  • If you send us reviews, photos, comments, or ideas (other than order-issue photos), you give us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display them in connection with our business.
  • You are responsible for what you submit. It must not be unlawful, abusive, or infringing, or violate anyone's privacy.
  • We may remove any submission at any time.
  • Photos you send us about an order problem are used only to resolve that problem and will not be published.

10. Third-party links and tools

The Site may include links to, or tools from, third parties. We do not control and are not responsible for third-party websites, products, or services. Your use of them is at your own risk and subject to their terms.

11. Prohibited uses

You may not use the Site to:

  • break any law;
  • infringe anyone's rights;
  • harass, abuse, or harm others;
  • submit false or misleading information;
  • upload malicious code;
  • collect other people's personal information; or
  • spam, scrape, or interfere with the Site's security or operation.

We may end your use of the Site if you violate these rules.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Site and all products and services are provided "as is" and "as available," without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot be excluded under applicable law. We do not guarantee that the Site will be uninterrupted, secure, or error-free.

13. Limitation of liability

To the fullest extent permitted by law:

  • SXD and its owner, contractors, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site or any product.
  • Our total liability for any claim is limited to the amount you paid for the product(s) the claim is about.

Some jurisdictions do not allow these limitations, so they may not all apply to you.

14. Indemnification

You agree to indemnify and hold harmless SXD and its owner, contractors, and service providers from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. Severability

If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent permitted, and the rest of the Terms will remain in effect.

16. Termination

These Terms apply until terminated by you or us. You can stop using the Site at any time. We may suspend or end your access if we believe you have violated these Terms. Sections that by their nature should survive termination will survive.

17. Entire agreement

These Terms, together with the policies referenced above, are the entire agreement between you and us about the Site. They replace any prior agreements or communications on that subject. If we do not enforce a right, we have not waived it.

18. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in San Joaquin County, California. Before starting any formal claim, please contact us at support@sexyxdrunk.com and give us 30 days to try to resolve it informally. Nothing in these Terms limits any rights you have under the mandatory consumer protection laws where you live.

19. Changes to these Terms

We may update these Terms at any time by posting the new version on this page. Changes take effect when posted. By continuing to use the Site after changes are posted, you accept the updated Terms.
